John Brown's Banishment from Stirlingshire

17 September 1788

One of the multiple oddities  in the story of Deacon Brodie, one of which is John Brown's trip to Stirlingshire in August to 17 September 1788. There are no indications why Brodie's minion went to the Falkirk / Stirling area, but while he was there he could not keep from nicking something. The document below is a copy of the original banishment paperwork that was provided to the Crown for William Brodie and George Smith's trial.

Stirling 17th September 1787

John Brown from Ireland who was incarcerated sometime ago for stealing sundry Articles of body cloths from James Jerire in Falkirk appearing and acknowledging the theft and praying to be liberated upon banishment under the usual certifications. The Justices therefore banishes him this [sic] county forever with certification if he is ever afterwards found therein, he will be apprehended, imprisoned, and whept thro the town three successive Fridays, and again banished under more severe certifications. Which enactment the said John Brown and the Justices hereby subscribe (signed) John Brown, James Young J. P.

[The following was added to the document for the trial of William Brodie and George Smith]

J. Alexander Littlejohn Clerk of the Peace of Stirling Shire, Do hereby certify and attest that the above is a fine copy of the original act of banishment out of the above John Brown of date the seventieth day of September last. The same having been duely [sic] collected and compared by me, with the original in my hands. At Stirling this thirteenth day of July one thousand and seven hundred and eighty-eight years. In presence of Ebenezer Brown Keeper of the Tolbooth of Stirling and James Young his servant.
